General terms and conditions - Monday EN
Monday NL is a one-man business founded by Hilde Eisma and located at Assendorperdijk 1, 8012EG Zwolle.

1.1 Offer: any offer from Monday NL to (potential) customers, such as programs, journals, downloads, coaching or training.
1.2 Client: the natural or legal person who uses the offer of Monday NL.
1.3 Agreement: the agreement between Monday NL and the client regarding delivery of a service or product.
1.4 Services/Products: including (but not limited to): live and online trainings, programs, coaching, e-books, downloads, journals, workshops, community access or other products (digital or physical).
1.5 Written: in addition to paper communication, this also includes email, text message, app or other digital communication.
1.6 Reimbursement: the amount the client pays for the service or product.
1.7 Monday National League: the company executing the contract.
2.1 These General Terms and Conditions apply to every offer, every agreement and all forms of cooperation with Monday NL.
2.2 Deviations are only binding if confirmed in writing by Monday NL.
2.3 By registration or purchase, the client agrees to these terms and conditions.
2.4 If any provision is void or nullified, the remaining provisions shall remain in full force and effect.
2.5 These conditions also apply to non-binding registration, such as for giveaways or events.
3.1 By registering or purchasing, the client consents to receive messages from Monday NL.
3.2 This includes practical information, service announcements, newsletters and promotions.
3.3 Monday NL processes data in accordance with the AVG.
3.4 Unsubscribing from promotional emails can be done via the unsubscribe link in each message.
4.1 An agreement is established upon registration, payment or written confirmation.
4.2 Monday NL provides an obligation of effort, not a guarantee of results.
4.3 Access, accounts or materials may not be shared with third parties unless expressly permitted.
4.4 In personal coaching, attendance and follow-up is the responsibility of the client.
5.1 All materials remain the property of Monday NL, including workbooks, slides, recordings, formats, tools and texts.
5.2 It is prohibited to copy, distribute, sell or commercially use material without written permission.
5.3 Violation will result in liability for damages and may lead to legal action, including court proceedings.
5.4 If these rights are violated, Monday NL reserves the right to terminate access to programs or communities immediately, without refund.
6.1 ‘lifetime access’ means as long as Monday NL is active and the relevant product or platform is made available.
6.2 ‘Lifetime’ does not mean the lifetime of the client.
6.3 Upon termination of services, access will expire without the right to a refund.
7.1 Invoices must be paid within 14 working days unless otherwise agreed.
7.2 Digital products are available immediately after purchase and non-refundable unless otherwise agreed in writing.
7.3 Live and group programs are subject to a statutory cooling-off period of 48 hours, if not yet started.
7.4 In the case of payment in installments, the payment obligation shall remain unaffected.
7.5 Late payment may result in access being blocked and interest or fees being charged.
7.6 The statutory withdrawal period expires in the case of direct access to digital content.
7.7 When purchasing digital products or access to programs, the customer expressly agrees to direct delivery and thereby waives the statutory right of withdrawal, in accordance with Article 6:230p of the Dutch Civil Code.
7.8 If payment is not made, Monday NL reserves the right to dissolve the agreement, terminate access and charge any collection fees.
8.1 Monday NL makes every effort to ensure optimal availability of platforms and services.
8.2 Monday NL is not liable for temporary unavailability due to maintenance, force majeure or technical failures.
9.1 Access to online environments, products and communities is strictly personal.
9.2 Sharing accounts or materials is prohibited and may result in immediate termination of access without refund.
10.1 Monday NL reserves the right to change or discontinue content, design or availability of programs or products.
10.2 Such changes will not entitle you to a refund.
11.1 Ongoing services (such as memberships or communities) may involve automatic renewal.
11.2 Termination must be in writing with at least 1 month's notice prior to renewal.
12.1 Discounts and promotions are not redeemable for cash.
12.2 Actions cannot be combined unless specifically stated.
12.3 Monday NL reserves the right to modify actions or terminate them early.
13.1 Monday NL is not liable for any failure or delay in fulfilling obligations due to force majeure, including illness, pandemics, government measures or technical failures.
14.1 The client acknowledges that coaching and training from Monday NL does not constitute therapy, medical advice or financial/legal advice.
14.2 The responsibility for applying insights lies with the client.
15.1 Monday NL shall not be liable for any direct or indirect damages resulting from the use of its services, except in the case of intent or gross negligence.
15.2 Liability is limited to the amount paid for the relevant service.
16.1 Monday NL processes personal data in accordance with the AVG.
16.2 Data will not be shared with third parties without permission and used only for the intended purpose.
16.3 Monday NL takes appropriate technical and organizational measures to protect personal data from loss or any form of unlawful processing.
17.1 Complaints should be submitted in writing within 7 days of delivery via hello@mon-day.nl.
17.2 Monday NL will respond with an appropriate solution within 14 days.
17.3 A complaint does not suspend the payment obligation.
18.1 All agreements shall be governed exclusively by Dutch law.
18.2 In the event of a dispute, the parties shall first jointly seek a solution.
18.3 If necessary, disputes shall be submitted to the competent court in the Netherlands.
19.1 Monday NL reserves the right to warn, temporarily deny access to the community or permanently remove participants who engage in inappropriate behavior, misconduct, harassment or other disruptive behavior.
19.2 In the event of serious or repeated misconduct, Monday NL may decide to unilaterally terminate a (group) course or program for the participant concerned.
19.3 In such cases, the client shall not be entitled to a refund or compensation.
